3. Services

Forte Web Solutions Ltd trading as Affordable Websites USA provides website design, development, hosting, search engine optimization, and related digital marketing services to small businesses across the United States. Our websites are built using HighLevel, AI-powered website builders, and similar proprietary platforms. This is an important characteristic of our service and has implications for platform portability as described in clause 10 below. 4. Eligibility

By using this Site or purchasing our services, you confirm that:

• You are at least 18 years of age
• You are a business owner or authorised representative of a business
• You have the authority to enter into a legally binding agreement
• All information you provide to us is accurate and complete

5. Website Subscriptions and Pay Monthly Plans

5.1 Our Pay Monthly website plan is provided on a subscription basis at the advertised price at the time of sign-up.

5.2 Your subscription begins on the date your website goes live or on the date agreed in writing, whichever is earlier.

5.3 Subscriptions are billed monthly in advance. Payment is due on the same date each month.

5.4 Minimum Contract Term: Your subscription has a minimum initial term of 12 months from the date your website goes live. During this initial 12-month period, the subscription cannot be cancelled except in the circumstances described in clause 13. If you wish to cancel during the initial term, the remaining monthly fees for that term become immediately due and payable. 5.5 Cancellation After the Initial Term: After the initial 12-month term has been completed, you may cancel your subscription at any time by providing 30 days written notice to us via our Contact page at www.affordablewebsitesusa.com/contact. Notice must be received before your next billing date to avoid being charged for the following month.

5.6 Upon cancellation, your website will remain live until the end of the final paid period, after which it will be taken offline. Please note clause 10 regarding platform portability — your website cannot be transferred to another hosting provider in its current built form.

5.7 We reserve the right to adjust subscription pricing with a minimum of 30 days written notice. Continued use of the service after the notice period constitutes acceptance of the new pricing.

6. Smarter Website Plans (Setup Fee and Monthly Fee)

6.1 Smarter Website plans require a one-time setup fee as advertised at the time of purchase, plus an ongoing monthly management fee.

6.2 The setup fee is due upon signing of the service agreement and is non-refundable once the design and build process has commenced.

6.3 Monthly fees commence on the date your website goes live or 60 days after the setup fee is received, whichever is earlier.

6.4 The minimum contract term and cancellation terms for monthly fees are as set out in clauses 5.4 and 5.5 above.

7. Payment

7.1 We accept payment by credit card, debit card, and bank transfer. For online payments we use Stripe, a third-party payment processor. Your payment details are never stored by us — they are handled securely by Stripe in accordance with PCI DSS standards.

7.2 Some clients may be invoiced directly and payment terms will be stated on the invoice. Standard invoice payment terms are 14 days from the date of invoice unless otherwise agreed in writing.

7.3 We reserve the right to suspend or terminate services in the event of non-payment. We will provide written notice before any suspension takes place.

7.4 All prices are quoted and charged in US Dollars (USD) unless otherwise agreed in writing.

8. Client Responsibilities

To enable us to deliver your website on time and to the agreed specification, you agree to:

• Provide accurate and complete information about your business when requested
• Respond to requests for content, feedback, and approvals within a reasonable timeframe (typically 5 business days)
• Ensure that any content, images, or materials you provide to us do not infringe the intellectual property rights of any third party
• Obtain all necessary licenses and permissions for any third-party content you wish to include on your website
• Notify us promptly of any changes to your business information that affect your website

We are not responsible for delays caused by a client's failure to provide required information or approvals within a reasonable timeframe.

9. Intellectual Property

9.1 The written content, images, branding assets, and overall design concept created specifically for your website by us shall, upon receipt of all payments due, belong to you. You are free to use this content in other marketing materials.

9.2 However, please note that your website is built within a proprietary platform (HighLevel or a similar AI-powered website builder). The underlying platform, its templates, structure, codebase, and associated technology remain the property of the respective platform provider and are subject to that provider's own terms and licenses. We do not transfer ownership of any platform technology or license to you.

9.3 This means that while your content and design concept are yours, the website in its built form exists within our platform account. As described in clause 10, the website cannot be exported or transferred to another hosting platform in its built form.

9.4 We retain the right to display your website in our portfolio and use it in our marketing materials unless you request otherwise in writing.

9.5 All intellectual property rights in the Affordable Websites USA brand, including its name, logo, and website content, remain the property of Forte Web Solutions Ltd.

9.6 You may not copy, reproduce, or distribute any part of our website, marketing materials, or service materials without our prior written consent.

10. Platform, Hosting, and Portability

10.1 Your website is built using HighLevel, an AI-powered website builder, or a similar proprietary platform. This is an integral and disclosed characteristic of our service.

10.2 Important — Platform Portability: Because your website is built within a proprietary platform, it cannot be exported, transferred, or migrated to another hosting provider, content management system (such as WordPress), or plain HTML hosting in its current built form. The website design, structure, and functionality are tied to the platform on which it is built.

10.3 If you choose to cancel your subscription and move to a different website provider, your new provider will need to rebuild your website from scratch. Your written content and any images you have provided to us will be returned to you upon request so that your new provider can use them.

10.4 We are transparent about this characteristic before you sign up and encourage you to ask any questions about it before committing to our service. By accepting these Terms, you confirm that you understand and accept this platform characteristic.

10.5 We aim to provide a minimum of 99.9% hosting uptime but cannot guarantee uninterrupted service. We reserve the right to carry out scheduled maintenance and will endeavour to provide advance notice where reasonably practicable.

10.6 We are not liable for any loss of business, revenue, or data arising from hosting downtime outside of our reasonable control.

11. Limitation of Liability

11.1 To the maximum extent permitted by applicable law, Forte Web Solutions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services or this Site.

11.2 Our total aggregate liability to you for any claim arising in connection with our services shall not exceed the total fees paid by you to us in the three months preceding the claim.

11.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Warranties and Disclaimers

12.1 We warrant that our services will be performed with reasonable care and skill.

12.2 We do not warrant that our services will be error-free or that your website will achieve any specific search engine ranking or business result. SEO outcomes depend on many factors outside our control.

12.3 The information on this Site is provided for general informational purposes only and does not constitute professional legal, financial, or business advice.

13. Termination

13.1 Either party may terminate a service agreement immediately by written notice if the other party commits a material breach of these Terms and fails to remedy that breach within 14 days of written notice requiring them to do so.

13.2 We reserve the right to suspend or terminate services immediately and without notice if we reasonably believe you are using our services for any unlawful or fraudulent purpose.

13.3 On termination during the initial 12-month term, any remaining monthly fees for that term become immediately due and payable unless termination is due to our material breach.

13.4 On termination after the initial term, any outstanding fees for services already delivered become immediately due and payable.

13.5 Upon termination for any reason, clause 10.2 (platform portability) continues to apply. Your website will be taken offline at the end of the final paid period and cannot be transferred to another provider in its built form.

14. Third-Party Services and Links

Our website and services may include links to third-party websites or integrate with third-party tools (including but not limited to Stripe, HighLevel, Facebook, and Google). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their own terms and conditions.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of any material changes by email or by posting a notice on our Site with a minimum of 30 days notice before changes take effect. Your continued use of our services after any changes take effect constitutes your acceptance of the new Terms. We recommend reviewing these Terms periodically.

16. Entire Agreement

These Terms, together with any written service agreement or proposal accepted by you, constitute the entire agreement between you and Forte Web Solutions Ltd in relation to our services, and supersede all prior communications, representations, and agreements relating to the same subject matter.
